Privacy Policy & POPIA Notice

This notice explains how Indlu Living (Pty) Ltd ("Indlu", "we", "us") collects, uses, shares, and protects your personal information when you browse our site, message us on WhatsApp, or apply for rental‑backed finance. It is written to align with South Africa’s Protection of Personal Information Act, 2013 (POPIA).

What we collect

  • Identity & contact: name, SA ID number, email, phone, address.

  • Income & affordability: payslips/income proof, bank statements (typically 3 months), credit and affordability checks.

  • Property & rental proof: leases, letters of intent (LOIs), tenanting plans, market demand evidence, photos/plans/specs.

  • KYC/FICA data: documents required under South African law to verify identity and prevent fraud.

  • Usage data: device, IP, and basic analytics/cookies to improve this site.

How we use your information

  • Pre‑assessment and eligibility for rental‑backed finance.

  • FICA/KYC verification and fraud prevention.

  • Onboarding, Partner Portal access, and rental management support.

  • Funding, disbursements, and ongoing account servicing.

  • Customer support and communications (including WhatsApp).

  • Compliance with legal/contractual obligations and resolving disputes.

  • Improving our products, site performance, and user experience.

  • Direct marketing with your consent (you can opt out at any time).

Our lawful bases under POPIA

  • Consent for specific optional uses (e.g., marketing).

  • Contract to assess, provide, and service your finance facility.

  • Legal obligation for FICA/AML and other regulatory requirements.

  • Legitimate interests such as security, fraud prevention, and improving our services in ways that respect your privacy.

Sharing your information

We share information only as needed for the purposes above:

  • Service providers (cloud hosting, analytics, KYC/FICA and credit bureaus, document collection tools, secure storage).

  • Professional partners (architects, QS/engineers, vetted contractors) to deliver compliant, tenant‑ready units.

  • Funding and credit partners, and where required, regulators or law enforcement.

We contractually require processors to protect your data and use it only on our instructions.

Cross‑border transfers

Some services (e.g., cloud hosting, WhatsApp) may store/process data outside South Africa. When we transfer information, we implement appropriate safeguards, including contractual protections, consistent with POPIA.

Retention

We keep personal information only as long as necessary for the purposes above and to meet legal obligations. Certain records (e.g., FICA) may need to be retained for a statutory period (often up to 5 years after the relationship ends), after which we delete or de‑identify them.

Your POPIA rights

  • Request access to the personal information we hold about you.

  • Ask us to correct or update inaccurate information.

  • Request deletion where applicable, or object to certain processing (including direct marketing).

  • Withdraw consent where processing relies on your consent.

  • Lodge a complaint with the Information Regulator (South Africa).

Using WhatsApp

When you click “Apply on WhatsApp”, your message is processed by WhatsApp. Avoid sharing sensitive documents in chat unless requested by our consultant, who may provide a secure upload method. WhatsApp’s own privacy terms apply to your use of their service.
